1. Plaintiffs seek to recover sums fraudulently procured by
Defendants from Plaintiffs since at least 1998, by means of
medical and chiropractic billings for unnecessary and unreasonable
treatment, examinations, diagnostic tests, and other services in
regard to persons involved in automobile collisions. Plaintiffs
also request relief under the Federal Declaratory Judgment Act, 28
United States Code, Section 2201, to determine their duty to pay
for purported medical and chiropractic treatment of certain
insureds, and third parties making claim against insureds, and
their right to recover such payments previously made to Defendants.

2. Plaintiffs would show this Honorable Court that Defendants are
co-owned or otherwise financially related. Patients were referred
between various Defendants for a set course of chiropractic
treatment, diagnostic tests and evaluation, medical consultation,
and other services, regardless of medical/chiropractic need and
necessity. Defendants would then generate narrative reports,
itemized billing statements, and HCFA-1500 forms based on the
unnecessary treatment and diagnostic testing, to substantiate the
treatment and testing. These documents would be presented to

DALLAS — The crimes are serious; the punishments non-existent.

A News 8 investigation found the Dallas Police Department has dropped charges in more than 40 family violence cases this year where the suspect was an illegal immigrant.

At least eight were serious felony cases where the victims were held at knife-point.

Instead of going on trial, the suspects were released from jail and deported.

"Deportation is not a substitution for holding a criminal accountable,” said Paige Flink, executive director of The Family Place, a resource center for victims of family violence.

In April, Dallas police said Carlos Flores pulled a butcher knife on his wife.

Then, police report, Flores told his wife he had killed three people in Honduras and that "he was not afraid to kill again."

Flores fell asleep holding the knife to his wife's throat.

"This is a very serious case,” said Flink.

Texas law recognizes that victims of family violence can be too frightened to cooperate. So the law, in essence, allows a police officer to serve as a primary witness for the prosecution.

For that reason, police on the Flores crime scene generated what's known as a family violence packet. In it are things like photographs, history of past injuries, statements given in the heat of the moment, and evidence, like weapons.

But Dallas police did not turn the Flores case over the district attorney for prosecution after Flores' wife filed documents asking that he not be prosecuted. So — despite the seriousness of the alleged crime and the evidence against Flores — he was released from jail and deported to Honduras.

"Well, that doesn't make sense,” Flink said.

In March, Dallas police arrested Mauricio Olivarez after he allegedly pulled a pocket knife on his common law wife saying, "I'm going to kill you."

Two days later, she filed a document with police saying she wanted the charges dropped. Olivarez was released from jail and bused back to Mexico.

In May, German Medrano allegedly "grabbed a kitchen knife and held it to (his wife's) throat." While Medrano sat in jail, Dallas officers could not locate his wife. Charges were dropped and Medrano was released from jail and bused back to Mexico.

DALLAS - A federal judge on Friday stopped a Dallas suburb's latest attempt to drive away illegal immigrants, ruling that Farmers Branch cannot enforce a ban on apartment rentals to those who can't prove they live legally in the country.

U.S. District Judge Jane Boyle's temporary restraining order stopped an ordinance that had been set to go into effect Saturday. The ordinance was intended to replace a similar measure that was struck down in federal court.

"We're very disappointed in Judge Boyle's view of the ordinance, but we're confident that ultimately it will be upheld by the federal court system," said Michael Jung, the attorney representing the city of Farmers Branch.

The judge said the ordinance has the potential to cause irreparable injury to landlords who are likely to lose business to neighboring cities that don't have similar laws.

In addition, she said the criminal penalties imposed on rental property owners who don't comply could be a "substantial threat" and cause irreparable harm.

In any case, the judge said the ordinance basically decides who can live in the city and poses a "slippery slope" should city officials attempt to override the role of the federal government on immigration matters.

She also was concerned about the city's use of a federal database to check the immigration status of rental applicants. The judge said database was not designed to determine the residency rights of prospective renters.

She said the court will follow up soon with a preliminary injunction hearing. That will allow the merits of the case to be fully heard.

Tim O'Hare, who steered the city's campaign against illegal immigrants as a first-term councilman and has since been elected its mayor, said he was not surprised by the decision.

"I think the judge is wrong," O'Hare said. "I think the will of the people of Farmers Branch is not being carried out. I think you'll ultimately see this matter resolved in the U.S. Supreme Court."

The measure required prospective apartment and house renters to obtain a city license. Under the rule, the city would forward information from the license application to the federal government for verification of a tenant's immigration status.

Mary Miller Smith, a former Farmers Branch city councilwoman who leases an apartment and opposes the ordinance, said she was "totally, totally, totally ecstatic" by the ruling.

"The thought of having to get a license to live in Farmers Branch was totally repulsive to me," said Smith, who is part of the federal lawsuit filed by a group of landlords.

Bill Brewer, who represents a group of rental ban opponents, said "we're very pleased Judge Boyle took the time to look at the ordinance" and carefully consider the facts.

The restraining order stems from a lawsuit _ one of several the city faces in a continuing nearly two-year battle over measures attempting to keep illegal immigrants from living in the city of about 28,000.

What do you think about illegals aliens employed as security guards @ 26 business?

A task force led by U.S. Immigration and Customs Enforcement raided more than two dozen mostly Latino night clubs, restaurants, pool halls and other businesses Saturday night, arresting 49 undocumented immigrants employed as security guards, officials said.All of those arrested work for two local security companies, which authorities declined to identify Sunday.

"We don't want to compromise the investigation so we're not releasing the two security company names yet," said Jamille Bradfield, spokeswoman for the Dallas County district attorney's office, which is participating in the investigation.

It's unclear if more arrests are expected, officials said.

Dallas, TX residents or law professionals only please...?

Dallas, TX residents or law professionals only please...?

1. Does anybody out there have links to personal injury attorneys for me in the Dallas area?
2. Has anybody out there (in the Dallas area) suffered from an on-site, work related injury/temporary or permanent disability? (if so, please tell me your story)

Long story short. In a menagerie of owners, general contractors, subcontractors, and employees I was injured while performing my job. I worked through the injury (in much pain) in order to complete the project. Yes, the injury was reported to my employer...the subcontractor. He did not suggest, advise, or otherwise seem to terribly concerned about getting me medical attention. Now I know why. He had no Workman's Compensation insurance.

Here's the problem: My employer is based out of Colorado. Also my home state. PI attorneys here in CO will not touch my case because the injury occurred across state lines. So, I have 2 options once I can find an attorney in the Dallas area.

1. File a claim/suit against the general contractor.
2. File a claim/suit against the owners of the property.

Please help. I'm in constant pain and have not held / cannot hold a job since Nov. 17th, 2008. To add insult to injury, my former employer has not responded to any of my phone calls or emails re: said injury.

Any ideas appreciated. Plz and Thx.
